The activity of amotarum
Actio rerum amotarum - in Roman law a special restitution order for the recovery of things stolen by a spouse, often used in the aftermath of divorce. Due to respect for the marriage institution (the honor of matrimony), theft between spouses was not considered to be a furtum infestation, but only the term "res amotae" was used.
In Digests, the entire title is dedicated to theft between spouses, as is the Justinian Code. The numerous and varied opinions of jurors on this subject indicate that it was a subject of intense interest in Roman law. Bibliography
