Edith Windsor, from the house of Schlain (born June 20, 1929 in Philadelphia, New York, September 12, 2017) is an American freelance activist, placed by Time magazine in third place in the "Person of the Year" (Person of the Year) in 2013, behind Pope Francis and Edward Snowden. Windsor questioned the validity of the marriage legislation in the United States and the definition of the word "spouse / spouse" and the United States Supreme Court adjudged it right. The context of Windsor's business was that her marriage to Thea Spyer (incorporated in Canada) was not legally recognized by American law and did not carry the usual matrimonial consequences. Edith Windsor met Thea Spyer in New York in 1963; They quickly decided to live together. In 1993 they registered their affiliate partnership. In 2007, Spyer's health began to deteriorate (she suffered from multiple sclerosis). In 2008, the couple decided to marry (which was held in Canada, as New York only married couples for homosexual couples in 2011).
After the death of Spyer in 2009, Windsor became her sole heir. As a spouse, she demanded state tax exemption for the fall, as was the case for other married couples. However, the US Defense of the Marriage Act (DOMA) claims that the term spouse applies only to heterosexual couples, and therefore Windsor should pay $ 363,053 tax. After several months of trial and series of appeals, the Supreme Court of the United States has decided that Windsor's claims are correct and discrimination against homosexual couples by DOMA is inconsistent with the Constitution.
