Unlike the invention, the utility model is only required to be new and have a technical character at the priority date (this may be a clear solution in the prior art). This allows conversions of the invention application to be filed with the original filing date if the patent office refuses to grant a patent for an invention which, according to the expert, is obvious to the person skilled in the art. This conversion is only possible for solutions that are themselves usable.
A utility model is granted to a utility model that authorizes the owner to use the utility model exclusively in a profitable or professional manner throughout the country. The duration of the patent right on the utility model is considerably shorter than the duration of the patent and is 6 or 10 years from the date of filing with the Patent Office.
In many countries (eg Germany and Austria), no new utility model is tested - it is protected by a minimum of formal requirements (registration procedure).
